Fourteen years later, in 2012, the recreational use of cannabis was also legalized in Washington State, making it one of two US states that permitted the use of cannabis outside of medical reasons. The other state to legalize recreational cannabis was Colorado.
Nowadays, CBD is legal in the state of Washington! Prior to 2018, the legality of cannabidiol products was not recognized on a federal level. Even though the Washington State government had legalized cannabidiol by then, the federal US government still deemed the substance illegal.

How the Farm Bill Changed Hemp Legislation
In 2018, a very monumental piece of legislation was passed by the US Congress. Known as the US Farm Bill of 2018, this ruling held significant importance for the CBD industry. Essentially, the Farm Bill made it clear that CBD and marijuana are to be treated differently.
Up until 2018, marijuana was used as a blanket statement that also referred to hemp. Instead of differentiating between the two, CBD and marijuana were placed into the same category under the Marijuana Tax act of 1937, which further perpetuated the industry’s already-misleading stigma.
The majority of CBD products are derived from hemp plants, which are not the same as marijuana plants. However, since both hemp plants and marijuana plants are both Cannabis Sativa plants, hemp and marijuana were placed into the same category for the longest time.
The Farm Bill of 2018 highlighted that hemp and marijuana are distinctly separate due to the differences in THC levels. For a product to be marketed as CBD, it must not contain a THC concentration greater than 0.3%, whereas there is no limit for THC levels in other cannabis products.
Hemp plants contain a significantly lower concentration of THC, which is the cannabinoid that causes psychoactive effects. Since CBD is extracted from hemp plants, cannabidiol products cannot cause people or pets to get high, which was clarified by the Farm Bill. As a result, CBD is no longer classified as a Schedule I drug and is now federally legal.
